Terms of Use
1. Identification and Acceptance
These Terms of Use govern access to and use of the platform operated by EPISÓDIO INTELIGENTE LDA., with registered office at Rua Francisco Sá Carneiro, 73, 2.º Frente, Carregal do Sal, District of Viseu, 3430-048, Portugal (hereinafter the “Platform”).
By accessing or using the Platform, the user declares that they have read, understood, and fully accepted these Terms. If you do not agree with any of the conditions set out herein, you must refrain from using the Platform.
2. Registration and User Account
Access to certain features of the Platform requires prior registration. The user undertakes to provide true, current, and complete information at the time of registration and to keep it updated over time.
The account is personal and non-transferable. The user is solely responsible for maintaining the confidentiality of their access credentials and for all activities carried out through their account. In the event of unauthorized use, the user must immediately notify the Platform.
3. Available Services
The Platform provides the following services:
- Search and purchase of sports event photographs
- Event organization and search by sport or date
- Content management area for partner photographers
- Download of purchased photographs
- Customer support services
4. Permitted Use
The user undertakes to use the Platform exclusively for lawful purposes and in accordance with these Terms. It is expressly prohibited to:
- Reproduce, redistribute, or commercialize purchased photographs without prior written authorization
- Use the images for defamatory, discriminatory purposes, or in any way that violates the rights of third parties
- Attempt to access restricted areas or circumvent the Platform’s security mechanisms
- Submit illegal or offensive content, or content that infringes intellectual property rights
- Use bots, scrapers, or any automated tools without authorization
5. Intellectual Property
All content on the Platform, including but not limited to texts, logos, design, software, and visual elements, is the property of EPISÓDIO INTELIGENTE LDA. or of third parties who have granted the respective license, and is protected by copyright and intellectual property laws.
The photographs available on the Platform are the property of the respective partner photographers. The purchase of a photograph grants the buyer a personal, non-exclusive license for use, without transferring ownership of the copyright.
6. Payments and Prices
The prices of the photographs are displayed in euros (EUR) and include all applicable taxes. The Platform reserves the right to change prices at any time, without prejudice to transactions already completed.
Payment is processed at the time of purchase through the available payment methods. Once payment is confirmed, the content becomes available for download.
7. Limitation of Liability
The Platform shall not be liable for indirect damages, loss of profits, or loss of data arising from the use of or inability to use the services. The Platform’s maximum liability under any circumstances shall be limited to the amount paid by the user in the transaction in question.
8. Changes to the Terms
The Platform reserves the right to amend these Terms at any time. Changes will be communicated to registered users by email and published on the Platform, indicating the date on which they take effect. Continued use of the services after the publication of the changes implies acceptance of them.
9. Applicable Law and Jurisdiction
These Terms are governed by Portuguese law. For the resolution of disputes arising from or related to these Terms, the parties submit to the jurisdiction of the courts of the district of Viseu, unless otherwise required by mandatory legal provision.
In the event of a consumer dispute, the user may resort to duly authorized alternative dispute resolution entities in Portugal, or to the European Consumer Centre.
